YOUR POND FARM TERMS AND CONDITIONS

NORMAL
You must provide your Garden Center, Pet Store or Landscaper business license issued by your city, county or state and/or state sales tax certificate in order to purchase products on a wholesale basis.

PAYMENT
We accept cash or check C.O.D. or Visa and MasterCard. Any other terms must be pre-approved and have a personal guarantee. All outstanding balances over 30 days are subject to a 1.5% service charge per month.

EARY ORDER
Early orders must be paid in full within terms or the discount is forfeited.
All Prebuy Orders Must Ship by April 15th.
Any orders shippings after April 15th will be billed at In-Season prices.

MINIMUM ORDER
Minimum order is $250. If the order is under minimum, it needs to be at least $150 and a $10 service fee will be charged. Small hard good orders can be shipped via UPS, FedEx or USPS.

FUEL SURCHARGE
A fuel surcharge will be added to all dlivered orders.

FISH SHIPPING
Fish are delivered on our own trucks. Fish shipments are also available via UPS Next Day Air. Next Day Air charges will apply. Insurance is available for purchase on fish shipped via UPS. A premium of 10% of the purchase price of the fish will apply. UPS does not gurantee live freight. If insurance is declined, the consignee assumes FULL RESPONSIBILITY for the live freight.

RETURNS
All returns must have a Return Goods Authorization number. Please call Your Pond Farm to receive a RGA number prior to returning the product. A 15% restocking fee will apply, no exceptions. All returns must be returned to us (or the manufacturer) freight prepaid. All products must be in original boxes and in new and unused condition. Products returned with price tags, mailing labels or other material on original packaging will incur a 25% charge. Credit will be issued against future purchases only. Perishible, dated or special orders are not returnable.

WARRANTY RETURNS
All warranty returns must have a Return Goods Authorization number prior to returning the product. Please call the office to receive the RGA number prior to returning merchandise. Returns must accompany a copy of the original cash receipt of sale along with an explanation of the problem. All returns must be returned to us or the manufacturer frieght prepaid or on our trucks with your next delivery. Items returned that are under warranty will be tested and either repaired, replaced or credited to your account according to the maufacturer's policy.

CLAIMS
NO claims will be allowed for shortage of merchandise unless noted on the shipping ticket at the time of delivery. Packing errors must be reported within 24 hours of delvery. In regards to truck freight, all box count shortages or damage claims must be handled with the carrier (No Exceptions). LIVE GOODS FREIGHT: Credit for air freight fish shipments, due to damaged boxes or late arrival, are the responsibility of the shipping company. PLEASE inspect boxes for damage upon arrival and file a claim with the SHIPPER, if necessary. Insurance is available on Next Day Air UPS only. Claims submitted for fish losses will be honored only if insurance has been purchased.

LIVE GOODS DELIVERY
Your Pond Farm trucks guarantee live delivery only. All problems must be reported to the driver at the time of delivery.

PAYMENT TERMS
ALL MERCHANDISE REMAINS THE PROPERTY OF YOUR POND FARM UNTIL INVOICE IS PAID IN FULL
Discounts applied to accounts in good standing.
Discounts based on volume and performance.
NO dating for fish and plant orders.
Any discrepancies must be reported within 24 hours.
